Today's Boston Globe story about the "per se" drunk driving law. 49 states have a law that states that when someone is measured at 0.8 percent alcohol in their blood they are guilty of DUI. Massachusetts is the only one that does not. Feds have threatened to withold highway funds if Massachusetts does not pass such a law.
The only people in the legislature opposed to such a law are the trial lawyers. The reason is "per se" laws like this eliminate most of the reason to go to trial in such cases, and they will lose the opportunity to obtain fees for such court appearances.
Case closed.
