You're going to eat this one I'm afraid if your laws are anything like Massachusetts. I've often done exactly what you've done, try to slow done gradually enough to give the moron behind time to not rear end me. It's a difficult call, but you're going to be listed as 100% at fault for this. My advice in this situation is if you think you're going to hit regardless slam on the brakes because if the tailgater behind hits you then THEY are responsible for 'pushing' you into the car in front of you. That's how the law works in MA - believe me from personal family experience.
