After reading the info from Dip, consulting with one of those "traffic lawyers" and friends I called the insurance company.
Still waiting to hear back from them...

PS- Dip, I never did replace the rear bumper (At the time I originally broke it I figured I'd rather spend the money on something better like new wheels. I'm more of a "function" guy rather than "form"). Perhaps I should have let the other guy hit me- I could have avoided fault (not necessarily at fault though) for the accident and got my bumper replaced!
