My experience with failing turbo seals is that they rarely leak badly (or appear to leak badly) when the turbo is producing boost or when the car is driven briskly. Of course, i don't know the full details of your situation.
My experience is that a failing turbo seal will result in oily smoke under the following conditions:
- on a warm or cold startup, perhaps only for 2 or 3 seconds (may not even be visible except under certain lighting conditions).
- after idling for an extended period of time particularly if the car has been started cold and left to idle
Try this: start the car from cold and let it idle for 10-15 minutes. Don't rev the engine in any way. If you are in an enclosed garage you may start to see a very thin haze or smell burning oil at near the end of this time period. Then get in the car and drive off vigourously. If the seals are starting to fail you will have a cloud of white smoke following you around for the next 5 minutes. This is accumulated leaked oil on the intake side of the turbo being fed into the engine.
All that said, i am not sure that partially burnt engine oil is always detected by emissions equipment (at least in my jurisdiction). I had an old VW that started to burn oil at an increasing rate to the over a period of years to the point where blue smoke was just visible and the smell of oil was distinct under all running conditions. Nevertheless, yearly emissions readings were always nearly identical. Not to say that cars don't fail testing for burning oil. Where i live, cars that are produce large amounts or blue smoke (when they arrive for testing) are identified by sight and turned away.
