Would that we lived in a land of common sense law. But we do not! Legislatures, judges and police, all focused on revenue generation rather than on fairness, have substituted an incomprehensible matrix of artificial law for anything based in morality or prudence. For a judge to fall back on the Basic Rule after a complete evidentiary collapse of the statutory house of cards would be unfair.
But that's never stopped 'em before!
I think it's pretty clear from what has been shown of the record here that we have NO IDEA how fast the guy was going.
