Ok Nick lets talk-
I don't know how things work north of our border, but you actually have the upper hand if you can be patient, keep a level head and move up the food chain (their chain of command).
1. If it was the other guy's fault try not to have your insurance co. pay for it... make his. Do not take no for an answer- keep a dairy w/ dates,times, names et.al. Keep asking for the people's (those who say no) bosses names/numbers and keep moving up. Remember you'll probably both compromise at a figure and you know where they're starting from so start at the other (high) end so if you split the difference you'll be happy.
2. Remember that you don't have to settle fast, that they have to provide you with alternate transporation/rental car, and they are betting (yes this is a poker game) that you'll give in first. They get paid to say no.
3. Don't accept any book values. You don't have a contract with them (your insurance company may even spell out book value w/no replacement value) so you should put the ball in their court and have you find, on the open market, a car just like yours for the money they're offering (probably impossible). You should try to find some comparable models as well to reinforce your position. Offer any good photos to them to document the condition of your beauty (see if they're interested... probably not).
4. The kicker- in the US you're intitled to "pain/suffering" costs (hard to define) and doctors & lost work time costs. Don't discuss this until you've settled the deal with your car (but not 'closed' the deal). Usually they might double the doctors/lost work costs, but there are no rules. They should pay for all checkups (get one) and associated tests. You never can tell how your neck will feel in months to come so be safe. Get as many tests as possible.
5. Hang in there (repeat daily until finished). Between holding your hand pat (real replacement car value) and the p/s costs you'll get your money one way or another. The more they say no the higher number 4 above might go.
