...I have had summonses thrown out up to 9MPH over. Part of my defense:
1) Speedometer error +/- 2
2) Radar gun error +/- 2
3) Moving cop car with radar gun wired to their speedo another +/- 2
To use this defense, you need to excercise your right to 'discovery'. You need to get the make model and serial number and repair record of the radar gun. Then you need to get a copy of the service manual of the radar gun. That will have the +/- error information. You also need the same information on the cop car and its speedo if they were involved. You need a copy of the officer's log. You can also get the officer's speed recognition rating. Some officers are bad.
I have been law abiding for some time now, but I did manage to fight and win or lose the points on all but one summonse. I got that summonse when I was 19, and I did not realize that the summonse for 39 in a 30 zone was wrong, as it was actually a 40 zone. From that time on I have paid attention to detail. That was my wake up call.
