From someone who has experienced the same thing, here are some almost-certainties:
1. OBD2 code reader isn't going to tell you a damn thing, don't waste your time or money. It will probably produce a code described as "front o2 sensor circuit failure". I think it's PO0130 or PO0133. Ok, so now what? Replace the sensor? Been there, done that, won't help.
2. The problem is most likely electrical: a contact resistance problem.
3. The problem is only in evidence because of your 3" downpipe. It's as if the change in flow rate is enough to push the readings close to the edge, making the rest of the system more finicky. Get rid of the 3" downpipe, and the CEL will go away. Alternatively, find the electrical problem. Mine turned out to be a spade terminal on the engine, near the false firewall, only visible from under the car (and even then, not very visible). I found it by accident, but cleaning it immediately removed the CEL that had been on for 2 years (except for the 200+ times I reset it with an OBD2 scanner). It has not returned in over 6 months so far.
