The R56 models (07+) aren't that well-sorted yet. The new 2011 models HOPEFULLY addressed some of the major engine issues, but BMW seems to like the band-aid approach until major redesign, so I'd go new or CPO only.
Check out northamericanmotoring . com for the lowdown. I had an R56 non-S model because I didn't want the engine hassles that the S included (carbon build up, infamous BMW HPFP, turbo issues) but it turns out the transmission problems are across the board. First time an automatic (again, only 07+ with real Aisin auto) was more reliable than a manual in my experience.
I'd also go new because the 07+ models don't get first oil changes until 15-16k miles. The engines (s and non-s) are all Peugeot sourced, good or bad, so keep that mind too.
Don't mean to sound bitter, but this is one of the rare times I'd recommend a Japanese car, namely a Miata, over a Euro car (MINI). For pure unapologetic RELIABLE driving fun.
No experience with 02-06 models but as someone else said RUN not walk from any CVT cars.
