Our sedan (a 626) was a total in 1999, other party at fualt. We were only a total when the disassembly showed the frame cracked on both sides up front.
Since our company had them at fault, they gave us a fantastic settlement under our collision, knowing that they had the leverage to maek the other driver's company pay up. We even got back 90% (the agreed fault) of our decutible. No negotiations were needed on our part, although I did my homework.
If this fits your situation, hope it helps.
