My '91 9000 CD in great condition with everythhing working was totaled by h&r driver. I got several offers from the ins co. Here is what will happen for you depending on your policy. The adjuster will forward your claim to the loss department at the insurance co. They will send the information on your car to an independant company that has a database of cars for sale. It is something like CCH. This company which gets paid by the insurance co will pick a few cars as comparables from this database and you will receive a report based on this information. They will add and subtract for mileage and options and condition. You can use the internet to check the cars in this report and you can call the dealers who have these cars for sale. Try cars com for example to find the cars. For me one car they used was from an old ad from Omaha newspaper (500 miles away) that said "'91 Saab runs good" with a price that was half book value. They have to use cars the same year or maybe one year newer. They have to be comparable cars. You can get pictures of these cars and info on mileage and options and condition. I went on the internet and found as many cars as I could that were for sale that were comparable and sent in that information to the insurance co. I also sent in all the receipts I had for the life of the car. They raised their offer. Then I got lucky and a car identical to mine (hard to find car) came on cars com and sold in a day for what I told them I wanted. They asked for the information and later gave ne their last offer. In the meantime I asked for the contact information for the independant company. I called them and started asking them questions. The person on the phone told me that someone else was researching my car at that moment. It was the insurance company. They were also calling. Remember to include proof of any repairs espeically ones in the last year. They will pay all or part of recent repairs. They also rebate some of what you paid for the license and they should pay for the tow and storage.
You have to agree with the insurance co in order to settle. If you do not agree then you have the right to an independant appraisal of your car. You pay for that and then the insurance co has to pay for a second independant appraiser. Try the phone book or internet. If the two can't agree they agree to hire a third aapraiser and that is what you get. Check your policy on your specific rights including your right to sue. I got a better offer and took it since we were not talking about enough money in the end. I got them to come up quite a bit. I threatened to take my policy elsewhere (4 cars and a house) and they didn't care. They later dropped my rates despite two claims for comp on two cars in one year. Don't accept their offer. Fight a little.
The adjuster can do nothing. The person in the loss department needs some documentation. They have to please the company. If they think they will have to pay for an appraiser and that they might lose in the process they will raise their offer. Good luck.
