It's really how the fog lights (or headlights) are aimed. Here in Maryland, the spec for inspection is a +/-4" drop at 25 feet, sot the lights can actually be aimed up and still pass. Consequently, I really get annoyed by headlights (low beams) that are aimed right in my eyes. Normally, they'd be fine, in terms of brightness, but the poor aim is what the issue really is.
Most fog lights I've seen aren't aimed high enough to bother anyone, even if they're not aimed well. Occassionally, I'll see one that's kind of in my eyes, but that's fairly rare. I've got aftermarket fog lights mounted above the bumper, aimed them festidiously, and actually asked friends if they're aimed too high (just to be sure). No one's bothered by them. I did the same with my headlights.
As for keeping fog lights on just to look cool, that's another issue altogether (and something I think is just silly).
